OBLIGATIONS OF THE USER

The User undertakes, in general, to use the Shop, to purchase the Products and to use each of the services of the Shop diligently, in accordance with the law, morality, public order and the provisions of these General Conditions, and must also refrain from using them in any way that could prevent, damage or impair the normal operation and enjoyment of the Shop by the Users or that could damage or cause damage to the property and rights of Kunde Brand s.l., its suppliers, Users or in general any third party.

CONDITIONS ON PROMOTIONS

The offers, promotions and discount codes in force, will not be cumulative between them. If you need more information about these terms do not hesitate to contact us by phone or by writing to Info@kundebrand.com.

PRODUCTS AND PRICES

a) Kunde Brand s.l. reserves the right to decide, at any time, the Products offered to the Users through the Shop. In particular, Kunde Brand s.l. may at any time add new Products to those offered or included in the Shop, it being understood that unless otherwise provided, such new Products shall be governed by the provisions of these General Conditions. Likewise, Kunde Brand s.l. reserves the right to stop providing or facilitating access to and use of any of the different types of Products offered in the Shop at any time and without prior notice.

b) The Products included in the Store will correspond in the most reliable way possible that allows web viewing technology to the Products actually offered. The characteristics of the Products and their prices are shown in the Shop. The prices indicated in the Store are in Euros and include VAT, unless otherwise indicated.

PROCEDURE AND METHOD OF PAYMENT OF THE PRODUCTS

a) Within a maximum period of twenty-four (24) hours, Kunde Brand s.l. will send an e-mail to the User, confirming the purchase. This e-mail will assign a reference code of the purchase, and will detail the characteristics of the Product, its price, the shipping costs and the details of the different options to make the payment of the Products to Kunde Brand s.l..

b) The User who purchases a product through the Shop must make the payment by means of the payment systems specifically detailed in the Shop.

c) The bank card with which the payment is made must be issued by a Spanish bank or savings bank.

d) Kunde Brand s.l. will file the electronic documents in which the contract is formalized, sending a copy to the User once the purchase has been made. The contract will be made in the Spanish language.

e) The order confirmation sent by Kunde Brand s.l. is not valid as an invoice, only as proof of purchase. Kunde Brand s.l. will send together with the Product the corresponding invoice.

RIGHT OF WITHDRAWAL

- Description of the right of withdrawal

You have the right to withdraw from this contract within14 calendar dayswithout giving any reason. The withdrawal period shall expire14 calendar daysafter the day on which you or a third party other than the carrier and indicated by you acquires the material possession of the goods.

To exercise the right of withdrawal, you must notify us(Kunde Brand, S.L, c/ Marian Burguès, 24, 08208, Sabadell, +34 930428545, info@kundebrand.com) of your decision to withdraw from the contract by means of an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the model withdrawal form below, but its use is not compulsory.

In order to meet the withdrawal deadline, it is sufficient that the communication concerning your exercise of this right is sent before the expiry of the withdrawal period.

- Consequences of withdrawal

In the event of withdrawal by you, we will refund to you all payments received from you, including the costs of delivery (with the exception of the additional costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us) without undue delay and, in any event, no later than14 calendar daysfrom the date on which we are informed of your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment used by you for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any costs as a result of the reimbursement. We may withhold reimbursement until we have received the goods back, or until you have provided proof of return of the goods, whichever is the earliest.

You must return or hand over the goods directly to us at Kunde Brand, S.L, c/ Marian Burguès, 24, 08208, Sabadell, Spain, without undue delay and in any event not later than14 calendar daysfrom the date on which you communicate your decision to withdraw from the contract to us. The deadline will be deemed to have been met if you return the goods before this period has expired. You shall bear the direct cost of returning the goods (if the withdrawal is voluntary).

You will only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

HOME DELIVERY SERVICE

a) The territorial scope of sales through the Store is for the territory of Spain and Portugal, so the delivery service will only be for those territories. The Products purchased through the Store will be sent to the delivery address indicated by the User once the payment has been verified. The usual delivery time for Kunde Brand is 1-3 working days from the date of the order.

INTELLECTUAL AND INDUSTRIAL PROPERTY

a) The User acknowledges that all the elements of the Store and of each of the Products, the information and materials contained therein, the brands, the structure, selection, arrangement and presentation of its contents, and the computer programs used in relation to them, are protected by intellectual and industrial property rights of Kunde Brand s.l. itself or of third parties, and that the General Conditions do not attribute any other rights with respect to these industrial and intellectual property rights other than those specifically provided for therein.

b) Unless authorized by Kunde Brand s.l. or, where appropriate, by the third party holders of the corresponding rights, or unless it is legally permitted, the User may not reproduce, transform, modify, disassemble, reverse engineer, distribute, rent, lend, make available, or allow access to the public through any form of public communication of any of the elements referred to in the previous paragraph. The User must use the materials, elements and information accessed through the use of the Store only for their own needs, agreeing not to make any direct or indirect commercial exploitation of the materials, elements and information obtained through the same.

PASSWORDS

a) Kunde Brand s.l. will facilitate the use of personal passwords to the user who registers as such on the website. These passwords will be used to access the services provided through the Web Site. The user must keep the passwords under his exclusive responsibility in the strictest and absolute confidentiality, assuming, therefore, any damages or consequences of any kind arising from the breach or disclosure of the secret. For security reasons, the password for telematic access to the services linked to the Website may be modified at any time by the User. The User undertakes to notify Kunde Brand immediately of any unauthorised use of his/her password, as well as access by unauthorised third parties.

COOKIES

a) Kunde Brand uses cookies in order to improve its services, facilitate navigation, maintain security, verify the identity of the user, facilitate access to personal preferences and track your use of the store. Cookies are files installed on the hard disk of the computer or in the memory of the browser in the folder pre-configured by the operating system of the User's computer to identify him/her.

b) If the User does not want a cookie to be installed on his or her hard drive, he or she should configure his or her Internet browsing program not to receive them. Likewise, the User may freely destroy the cookies. If the User decides to deactivate cookies, the quality and speed of the service may be reduced and he/she may even lose access to some of the services offered in the Store.

WARRANTY OF OUR PRODUCTS:

All products on our website and in our catalogs are covered by a warranty. If you use any of the products in an environment other than a home environment, please call us to check if the product you are interested in or are purchasing has a warranty for the environment it will be used in.

No product warranty will be covered if damage is caused by abusive or unreasonable use, nor if the customer alters the product in any way or if the customer fails to provide reasonable and necessary care.
